Our Agreement with You

Please note that these terms cover your online purchases. Your statutory rights as a customer are always protected and are not affected by anything stated here.

About Our Artworks

Product Descriptions

We strive for accuracy in all our artwork descriptions and images on the website. However, please understand that due to the unique nature of art, there might be slight variations in the size and colour of the piece you receive compared to what you see online. These are often inherent characteristics of handmade or artistic items.

Custom Orders

If you’re commissioning a special piece or requesting specific requirements, it’s essential that the information and specifications you provide are accurate.

Placing an Order

When you place an order, we’ll send you an acknowledgement. Your order is officially accepted, and our contract is complete, only when we dispatch the goods to you.

Availability

All artworks displayed on our website are subject to availability. We’ll do our best to keep our inventory updated.

Your Records

For your own records, please print a copy of these terms and conditions, along with your order acknowledgement, as we do not store these details for you to access later on our website.

Pricing

Currency

All prices for artworks sold through our website are in Pounds Sterling (£).

International Orders & Customs

For deliveries outside the European Economic Community (EEC), VAT is not charged. However, these orders must be placed directly with the gallery by telephone. Please be aware that customs and import duties are not included in the price for overseas deliveries. You are responsible for paying any such surcharges.

Price Errors

While we strive for accuracy, we reserve the right to notify you of any price errors before delivery. If this happens, we won’t dispatch the goods until you confirm you still wish to proceed with the purchase at the corrected price.

Payment

Accepted Methods

By placing an order, you agree to your credit or debit card being charged. We accept the following cards: VISA Credit, Mastercard, Electron, Maestro/Switch, Visa Debit, and Solo. We also accept cheques drawn on a major UK bank in £ sterling. Please note that goods will be dispatched only after your cheque has cleared, which typically takes five working days.

Receipt & Ownership

Upon successful payment, we’ll send you a receipted invoice by post. Ownership of the artwork transfers to you once we’ve received full payment.

Delivery

Shipping Address

Your artwork will be delivered to the shipping address you provide in your order.

Delivery Times

We aim to deliver your artwork within a maximum of 10 working days, and often within 5 working days. If you haven’t received your item(s) within 10 days of placing your order, please notify us immediately so we can track the parcel.

Shipping Charges

All shipping and delivery charges will be clearly displayed on your order form before you commit to your purchase.

Receiving Your Artwork

Once the artwork is delivered, it becomes your responsibility. Please examine the goods as soon as reasonably possible upon receipt.

Delays

While we do our best to meet delivery estimates, any dates provided are approximate. We are not liable for delivery delays. However, if we’re unable to deliver your goods by the quoted date, you have the right to cancel your order at any time before delivery.

Returns

Damaged or Defective Items

We take great care in checking and packing every artwork, but occasionally, items may arrive damaged, defective, or otherwise unacceptable. We’re committed to resolving these situations promptly.

If you receive a damaged item, you must notify Plymouth Art Gallery within 24 hours of delivery. We will then arrange collection and, if possible, provide a replacement. If a replacement isn’t available, you’ll have the option of choosing an alternative artwork or receiving a full refund.

If a limited edition print has sold out between dispatch and return, and a replacement cannot be found, a refund will be issued.

Your Right to Cancel (Distance Selling Regulations)

Under the Distance Selling Regulations, you have the right to cancel your order for any item purchased on this website prior to dispatch. This right does not apply to items that have been personalised or made to your specific requirements, such as commissioned works or pieces framed especially for you.

To cancel your order, please email us at enquiries@plymouthartgallery.co.uk or write to us at the address provided at the top of these terms. If you’ve already received the goods, you must return them to us at your own cost within seven days to Plymouth Art Gallery. Please ensure the artwork is securely packed and sent via a suitable courier.

Your Warranty

By placing an order, you confirm that all details provided on the order form are correct, that you are the legitimate owner of the credit card being used, and that sufficient funds are available to cover the cost of the goods.

Data Usage

Under the Distance Selling Regulations, you have the right to cancel your order for any item purchased on this website prior to dispatch. This right does not apply to items that have been personalised or made to your specific requirements, such as commissioned works or pieces framed especially for you.

Your privacy and security are paramount to us. We will never disclose your details to any third parties. We only collect personal information like addresses and phone numbers for our own purposes. Your payment details are processed securely off-site by Stripe, a leading UK Payment Service Provider known for its market-leading credit card verification and security. All credit card transactions are encrypted using 128-bit SSL.

All information gathered is collected lawfully and in accordance with the Data Protection Act 1998. We use your information primarily to process your order or enquiry and to provide you with the best possible customer service. The information we hold will be accurate and up-to-date, and you can verify it by emailing or writing to us.

Questions & Concerns

Should you have any complaints about our products or services, please put them in writing and email them to enquiries@plymouthartgallery.co.uk. We will acknowledge your complaint within five working days and provide you with a projected timescale for resolution, along with the steps we intend to take.

Our Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability that cannot be excluded by law.

However, we will not be liable for any economic losses (including loss of revenue, data, profits, contracts, business, or anticipated savings), loss of goodwill or reputation, or special or indirect losses arising from or in connection with the provision of any goods under these terms.

Our total liability for any loss or damage will not exceed the amount you paid or owe for the goods.

General Information

• You cannot transfer or sub-contract any of your rights or obligations under these terms.
• If any part of these terms is deemed invalid or unenforceable, the remaining sections will still apply.
• These terms do not create rights or benefits enforceable by any person not a party to this agreement (as per the U.K. Contracts (Rights of Third Parties) Act 1999).
• Any delay or failure by us to exercise our rights under these terms does not mean we’ve waived them. Any waiver must be in writing and signed by an authorised representative.
• These terms and conditions represent the entire agreement between you and us regarding your use of this website, superseding all previous understandings.
• These terms are governed by English law and are subject to the exclusive jurisdiction of the English Courts.
